Request Case Review
Request attorney review when deadlines, evidence, or insurer contact are active now.
01
If you are reading this, please accept our deepest condolences. We know legal issues are the last thing you want to deal with right now, but a few protective steps can help preserve records, deadlines, and decision-making options.
02
1. Immediate Steps (Days 1-3)
Secure the Vehicle: If your loved one's car is at a tow yard, consider whether photos, inspection, or preservation steps are needed before it is moved, repaired, sold, or disposed of.
Order the Report: Request the Official Oklahoma Traffic Collision Report from the responding agency (OHP, OKC PD, etc.). It usually takes 10-14 days to be finalized for fatalities.
Social Media Silence: Ask family members not to post details about the accident or the deceased's medical condition online. Insurance adjusters watch these pages.
03
2. The Probate Process
In many Oklahoma wrongful-death cases, filing authority runs through a court-appointed personal representative. If no personal representative is or has been appointed, Oklahoma law may allow the widow, or if there is no widow, next of kin to bring the action.
04
3. The Investigation
Crash reports may not answer every civil-liability question. They often focus on immediate crash reporting rather than the full evidence needed for a civil claim. We hire private accident reconstructionists to:
- Download the "black box" (EDR) data from all vehicles.
- Map the scene with drones.
- Analyze skid marks and crush damage to determine speed.
05
4. Dealing with Insurance
The at-fault driver's insurance company may call you. Be careful with recorded statements and early settlement offers. A release should be reviewed against available coverage, medical prognosis, work-loss issues, and any UM or commercial-policy questions before a decision is made.
06
5. Calculate Damages
Oklahoma law allows recovery for:
- Consortium: The loss of the relationship.
- Financial Support: What the deceased would have earned in their lifetime.
- Grief: The emotional suffering of parents.
- Mental Anguish: The suffering of the spouse and children.
Review the Record Early
Evidence can change quickly. Attorney review can help identify records, deadlines, and preservation issues.
