01
The Third-Party Loophole
In Oklahoma, you generally cannot sue your direct employer for negligence. However, an oil rig is rarely run by just one company. You have the Operator, the Driller, the Mud Logger, the Casing Crew, and the Water Hauler.
If anyone other than your direct boss caused your injury, you can sue them.
02
Comparison: Comp vs. Civil Suit
| Feature | Workers' Comp | Civil Lawsuit |
|---|---|---|
| Medical Bills | Yes (Selected Dr.) | Yes (Any Dr.) |
| Lost Wages | 70% (Capped) | 100% (Including future) |
| Pain & Suffering | NO | YES |
| Punitive Damages | NO | YES |
03
Example Scenario
You work for ABC Drilling. You are hit by a forklift driven by an employee of XYZ Casing.
- You file Workers' Comp with ABC Drilling (pays your immediate bills).
- You file a Civil Lawsuit against XYZ Casing (pays for your pain, suffering, and full wage loss).
This "hybrid" approach is the only way to get full justice for a catastrophic oil field injury.
Review the Record Early
Evidence can change quickly. Attorney review can help identify records, deadlines, and preservation issues.
